These Terms of Use (“Terms”) govern your access to and use of the Motion Horizons LLC website located at https://bolthunter.io (the “Site”) and any related services, content, or products provided through the Site (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. About Motion Horizons LLC

Motion Horizons LLC (“Motion Horizons,” “we,” “us,” or “our”) is a California limited liability company that designs and sells photography-related hardware products and accessories.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to purchase Products through the Services. You may browse the Site if you are under 18, but you may not place an order without the involvement and consent of a parent or legal guardian.

3. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms on the Site and update the “Last Updated” date above. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

4. Accounts

Account creation may not be required to browse or purchase Products. If we offer accounts in the future, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

We may suspend or terminate access if we reasonably believe these Terms have been violated or to protect the security or integrity of the Services.

5. Product Information and Availability

We strive to provide accurate Product descriptions, specifications, pricing, and availability. However, errors may occur. We reserve the right to correct errors and update information at any time without prior notice, including after an order is submitted.

Product images are for illustrative purposes only and may differ from the final Product.

6. Orders and Acceptance

Submitting an order constitutes an offer to purchase. We reserve the right to accept or reject any order for any reason, including Product availability, pricing errors, shipping limitations, or suspected fraud.

If an order is canceled after payment has been processed, we will issue a refund to the original payment method.

7. Pricing and Payment

All prices are listed in U.S. Dollars (USD) unless stated otherwise. Taxes, shipping, and handling charges (if applicable) will be displayed at checkout.

Payments are processed through Squarespace Payments and/or its integrated third-party payment processors. Motion Horizons LLC does not store full payment card information.

Prices may change at any time but will not affect orders already accepted.

8. Shipping and Delivery

Estimated delivery times are provided for convenience only and are not guarantees. Motion Horizons LLC is not responsible for delays caused by carriers, customs, weather, or other factors outside our control.

To the maximum extent permitted by law, title and risk of loss pass to you when the Product is delivered to the carrier.

International shipping, if offered, may be subject to customs duties, taxes, and fees imposed by the destination country. You are responsible for all such charges.

9. Returns and Refunds

Returns and refunds are governed by our separate Return Policy, which is incorporated into these Terms by reference and available on the Site. In the event of a conflict, the Return Policy controls.

10. Acceptable Use

You agree not to:

Violate any applicable law or regulation
Infringe or misappropriate the rights of others
Interfere with the operation or security of the Services
Attempt unauthorized access to systems or data
Use automated tools (scrapers, bots, crawlers) without our prior written consent
Upload or transmit malware or harmful code
Submit false, misleading, or unlawful information

We may restrict or terminate access for violations of this section.

11. Product Reviews and User Content

If the Services allow you to submit reviews or other content (“User Content”):

11.1 License

By submitting User Content, you grant Motion Horizons LLC a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, publish, display, and distribute such content for purposes related to the Services and Products.

11.2 Your Responsibility

You represent that:

You have the right to submit the User Content
The content is accurate where it states facts
The content does not violate any law or third-party rights

We may remove User Content at our discretion.

12. Intellectual Property

All content on the Services, excluding User Content, is owned by Motion Horizons LLC or its licensors and is protected by applicable intellectual property laws.

You may not use our trademarks, logos, trade dress, or branding without our prior written consent.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes.

13. Safety Disclaimer and Assumption of Risk

Photography involving lightning, storms, or severe weather is inherently dangerous and may result in serious injury, death, or property damage.

If you are close enough to photograph lightning, you are close enough to be seriously injured or killed. There is no way to eliminate risk while engaging in lightning photography or severe-weather activity, even when using specialized equipment.

Our Products are not safety devices and do not reduce or eliminate the risks associated with lightning, storms, travel, terrain, or outdoor conditions. The safest locations during lightning activity are generally enclosed vehicles or structures, but no environment is completely risk-free.

By using our Products, you acknowledge and accept that:

You are solely responsible for your safety and decisions
You assume all risks associated with lightning photography and severe weather
Motion Horizons LLC does not provide safety advice, weather guidance, or guarantees of safety

To the maximum extent permitted by law, Motion Horizons LLC is not responsible for injuries, death, property damage, or losses arising from your activities or use of the Products.

14. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Some jurisdictions do not allow certain disclaimers, so portions of this section may not apply to you.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOTION HORIZONS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICES OR PRODUCTS.

OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM IN THE SIX (6) MONTHS BEFORE THE EVENT, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow limitations of liability, so this section may not fully apply to you.

16. Indemnification

You agree to indemnify and hold harmless Motion Horizons LLC and its officers, employees, and agents from any claims, damages, losses, or expenses arising from your violation of these Terms or your use of the Services.

17. Privacy

Your use of the Services is subject to our Privacy Policy, which explains how we collect and use information.

18. Accessibility

19. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

20. Dispute Resolution and Arbitration

20.1 Informal Resolution

Before initiating arbitration, you agree to contact us at info@bolthunter.io and allow us 30 days to attempt to resolve the dispute informally.

20.2 Arbitration

Any dispute not resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will take place in Sacramento County, California, unless otherwise agreed.

YOU WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.

20.3 Exceptions

Either party may bring qualifying claims in small-claims court or seek injunctive relief for intellectual property matters.

20.4 Opt-Out

You may opt out of arbitration within 30 days of first accepting these Terms by sending written notice to:

21. Termination

We may suspend or terminate access to the Services at any time if we reasonably believe these Terms have been violated or to protect the Services.

22. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, severe weather, supply-chain disruptions, or carrier delays.

23. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

24. Assignment

You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
